Terms of Service

These Terms of Service ("Terms") govern your use of the MK Logistics website (mklogistics.services) and any services provided by MK Logistics ("we", "our", "us"). By using our website or services, you agree to these Terms.

1. Services

MK Logistics provides dispatch, back-office, compliance, fleet management, growth, and financial-coordination services to motor carriers operating under valid US authority. The specific scope of services for each client is governed by a separate service agreement signed at onboarding.

2. Eligibility

To engage our services, you must operate a motor carrier business with valid USDOT and MC authority (where applicable), valid commercial insurance, and the legal authority to enter into a service agreement on behalf of your business.

3. Pricing & Payment

• Pricing is communicated and agreed upon in writing before services begin.
• Service fees are typically a percentage of gross load revenue, billed weekly.
• Late payment may result in service suspension until accounts are current.
• There are no setup fees or long-term lock-in contracts. Either party may terminate the service relationship with one week's written notice.

4. Carrier Responsibilities

• Maintain valid operating authority, insurance, and compliance with all FMCSA and DOT regulations.
• Provide accurate equipment, driver, and operational information.
• Operate safely and in accordance with Hours of Service rules.
• Respond to dispatch communications in a timely manner.

5. Our Responsibilities

• Provide dispatch and support services with professionalism and care.
• Work in good faith to secure profitable loads consistent with the carrier's stated preferences.
• Handle paperwork, broker communications, and back-office tasks within agreed scope.
• Maintain confidentiality of carrier financial and operational data.

6. Limitations of Liability

MK Logistics acts as a service provider, not as a broker or motor carrier. We do not assume liability for cargo, equipment damage, accidents, freight claims, broker disputes, or load-related financial losses. Our maximum liability for any claim arising from our services is limited to the service fees paid by the carrier in the three (3) months preceding the claim.

7. Independent Contractor

The relationship between MK Logistics and any carrier client is that of independent contractors. Nothing in these Terms creates an employer-employee, partnership, agency (except as expressly authorized for dispatch purposes), or joint venture relationship.

8. Website Use

The content on this website is for informational purposes only. Statistics, service descriptions, and testimonials reflect typical results but are not guarantees of any specific outcome.

9. Intellectual Property

All website content — text, graphics, logos, and design — is the property of MK Logistics and may not be reproduced without written permission.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Travis County, Texas.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
